RETURNS AND COMPLAINTS

At TERRA-LEAF LTD, we want you to be completely satisfied with your purchase. If you are not happy with your plant or other product, please review our policies below to understand your available options.

WARRANTY
Our legal obligation is to deliver the ordered goods without defects. However, if the received product has hidden defects or becomes damaged during use for reasons beyond your control, you may exercise warranty rights, provided that a warranty has been granted by, for example, the manufacturer, importer or seller, the warranty conditions have been specified in the warranty document you received with the goods, and the defect that has occurred is covered by the warranty and its period has not yet expired.
COMPLAINT
Independently of the above, if after making a purchase it turns out that the received goods are damaged or you have identified any other non-conformity of the goods with the contract concluded, you have the right to submit a complaint. As a general rule, defective goods should be returned to the seller to enable them to examine the validity of the complaint. We always request photographs of the received products as standard to expedite the complaints process. In case of doubt, please contact us to determine the next steps. For purchases of live goods such as plants, insects etc., we accept complaints within 48 hours of receiving the goods.
PRODUCT RETURN – 14-DAY RETURN GUARANTEE

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to withdraw from your purchase without giving reasons within 14 days of the date of receiving the package. From 2021, this rule also applies to sole traders who enter into contracts unrelated to their professional activities.

You may exercise this right by submitting a written statement of withdrawal within the above period. When writing a statement as a consumer, you may use a generally available template. Persons making purchases as sole traders unrelated to their professional business activities are asked to use the template available here. To meet the withdrawal deadline, it is sufficient to send the withdrawal statement in paper form or by email to contact@terra-leaf.co.uk

You should return the product without undue delay, within no more than 14 days, to our warehouse address: TERRA-LEAF LTD, Unit 5, Industrial Estate Road, Chelmsford, Essex CM1 2XX, United Kingdom.

You shall bear the cost of return shipping. You can determine the approximate cost of return based on our “Delivery Costs and Methods” section.

Remember that the right to withdraw from the contract does not allow free use of the product. According to regulations, if the returned product has been used to a greater extent than necessary to establish its nature, characteristics and functioning, the seller has the right to charge the buyer for the costs of its diminished value.

In case of withdrawal from the contract, you will receive a refund of the amount paid for the purchase – the price of products, shipping costs and other costs, except for the above-mentioned return costs. The money will be transferred to the account you specify. This will happen immediately after we receive the returned purchase, no later than 14 days.

According to law, the right of return does not apply when the subject of sale is:

  • a non-prefabricated item created to the consumer’s individual order,
  • an item that deteriorates rapidly or has a short shelf life (such as plants, biological plant protection products, or live pollinating insects),
  • an item delivered in sealed packaging which cannot be returned after opening for health protection or hygiene reasons,
  • items which, after delivery, become inseparably mixed with other items due to their nature,
  • audio or visual recordings delivered in sealed packaging, if the packaging has been opened after delivery,
  • newspapers, periodicals or magazines, except for subscription contracts,
  • digital content not recorded on a physical medium, if performance has begun with the consumer’s express consent.
OUT-OF-COURT DISPUTE RESOLUTION
In case of objections to transactions and disputes with the seller, there is a possibility of resolving the dispute through alternative dispute resolution. The appropriate bodies for resolving commercial disputes include Citizens Advice consumer service, relevant ombudsman services, and approved Alternative Dispute Resolution (ADR) providers. Referring a matter to these institutions typically requires agreement from both parties.
